1. Agreement
These Terms & Conditions govern use of the Elkins Babe Ruth Baseball website, communications, registrations, stores, fundraisers, raffles, ticketing, and other services made available through or linked from this site. By using the site or completing a transaction, you agree to these Terms and any additional rules displayed for the applicable activity.
2. Parent or Guardian Responsibility
Because Elkins Babe Ruth serves youth players, a parent or legal guardian must complete registrations, purchases, consents, and submissions involving a minor unless expressly permitted otherwise. The person submitting information represents that it is accurate and that they have authority to provide it.
3. League Information and Participation
Eligibility, age divisions, team placement, schedules, fields, rules, conduct requirements, and participation availability may change. Registration does not guarantee a particular team, coach, position, schedule, number of games, or playing time.
4. Online Payments and Third-Party Platforms
Payments, donations, registrations, event tickets, raffle entries, merchandise, and other transactions may be processed through Panovents, BashTIX, Stripe, or another authorized provider. The applicable provider may impose additional terms, privacy practices, processing requirements, or technical limitations. Elkins Babe Ruth does not receive or store full payment card numbers on this website.
5. Fundraisers, Raffles, and Drawings
Elkins Babe Ruth may promote or conduct fundraisers, raffles, drawings, contests, ticketed events, or similar activities only where permitted and subject to applicable federal, state, and local law. Each activity may include separate official rules governing eligibility, entry periods, ticket limits, prize details, drawing procedures, winner verification, claim deadlines, and other requirements. The activity-specific rules control if they conflict with these general Terms.
Raffle or drawing participation is void where prohibited. Entrants are responsible for confirming that they are legally eligible to participate. Entries may not be transferred, altered, reproduced, or obtained through unauthorized means. Elkins Babe Ruth may reject or void entries associated with fraud, chargebacks, payment failure, technical manipulation, ineligible participants, or violations of posted rules.
6. Stripe Restricted and Prohibited Activities
Stripe and other payment providers maintain restrictions on certain businesses, products, prizes, and transactions. Elkins Babe Ruth reserves the right to refuse, remove, modify, postpone, or cancel any item, prize, campaign, or transaction that may violate law, payment-processor requirements, platform rules, or league policy. Stripe's restricted-business information is available at stripe.com/legal/restricted-businesses.
7. Orders, Availability, and Pricing
Prices, quantities, dates, and availability may change before a transaction is completed. An order confirmation does not require fulfillment when a payment fails, an item is unavailable, information is incorrect, the transaction is prohibited, or an obvious pricing or technical error occurred. Merchandise colors, sizing, and appearance may vary.
8. Refunds
Refund eligibility is governed by the Refunds & Cancellations page and any activity-specific terms. Processing fees, service charges, donations, sponsorships, and raffle entries may be nonrefundable except where required by law or expressly stated otherwise.
9. Facebook and Embedded Content
Facebook feeds and other embedded third-party content are provided for convenience. Elkins Babe Ruth does not control third-party availability, tracking, content, or platform changes.
10. Acceptable Use
You may not interfere with the site, attempt unauthorized access, submit false information, misuse player or league information, introduce malicious code, scrape protected information, impersonate another person, or use the site for unlawful purposes.
11. Intellectual Property
League names, logos, graphics, photographs, text, and other content are owned by or licensed to Elkins Babe Ruth unless otherwise stated. Unauthorized reproduction or commercial use is prohibited.
12. Disclaimers and Limitation of Liability
The website and linked services are provided on an "as available" basis. To the fullest extent allowed by law, Elkins Babe Ruth and its officers, coaches, volunteers, representatives, and service providers are not liable for indirect, incidental, special, or consequential damages arising from use of the website, a third-party platform, a canceled or changed activity, or an interrupted transaction.
13. Governing Law
These Terms are governed by the laws of the State of West Virginia, without regard to conflict-of-law principles.
